My latest article for the California Lawyers Association helps lawyers navigate conflicts of interest that arise during an ongoing engagement. Such conflicts can arise in a variety of ways. It is important that lawyers handle midstream conflicts in an appropriate manner. In some cases, an additional disclosure and waiver with informed written consent is appropriate. In other cases, if consent cannot be obtained, the lawyer may need to withdraw from representation of some or all of the parties. This may depend in part upon the provisions in the original engagement letter and conflict waiver.
